By accessing or using this Website, submitting a service request, requesting an estimate, or otherwise engaging with our services, you agree to these Terms.

If you do not agree with these Terms, please do not use this Website.

2. Website Use

You may use this Website only for lawful purposes.

You agree not to:

  • Use the Website in violation of applicable laws or regulations

  • Attempt to gain unauthorized access to the Website, servers, accounts, or systems

  • Introduce viruses, malware, malicious code, or other harmful technology

We may restrict or terminate access to the Website if we reasonably believe it is being misused.

3. Service Requests and Appointments

Submitting a contact form, requesting service through the Website, calling us, or otherwise contacting Cox Climate Control does not guarantee an appointment or establish a binding service agreement.

Appointments are subject to confirmation and technician availability.

We may contact you by phone, email, or other contact method you provide to:

  • Confirm appointments

  • Discuss your HVAC or refrigeration needs

  • Provide scheduling updates

  • Request additional information

  • Discuss estimates or recommendations

  • Provide service-related communications

Customers are responsible for providing accurate contact, property, and equipment information.

4. Estimates and Quotes

Any estimate, quote, or pricing information provided by Cox Climate Control is based on the information and conditions reasonably available at the time of evaluation.

Unless otherwise stated in writing, estimates are not guaranteed final prices.

The final cost may change if we discover:

  • Hidden or inaccessible damage

  • Previously unidentified equipment problems

  • Electrical, plumbing, structural, ventilation, or code-related issues

  • Additional labor requirements

  • Additional parts or materials needed

  • Unsafe site conditions

  • Changes requested by the customer

  • Conditions that could not reasonably have been identified during the initial inspection

If additional work is required, we will make reasonable efforts to explain the situation and obtain customer authorization before performing significant additional work.

A written proposal or service agreement may contain additional terms specific to the project. If there is a conflict between these Website Terms and a signed written agreement, the signed agreement will control with respect to that service.

5. Diagnostic Services

HVAC and refrigeration systems can involve interconnected mechanical, electrical, ventilation, refrigerant, and control components.

Our technicians will use professional judgment and reasonable diagnostic methods to identify equipment problems.

However, some problems may not be apparent until equipment is disassembled, repaired, tested under operating conditions, or additional components are evaluated.

A diagnostic visit does not guarantee that every existing or potential problem with a system will be identified.

6. Customer Responsibilities

Customers agree to provide reasonable and safe access to the property and equipment requiring service.

Before an appointment, customers should ensure that:

  • Technicians can safely access the equipment

  • Work areas are reasonably clear of obstructions

  • Pets are secured when necessary

  • Children and unauthorized individuals remain away from active work areas

  • Relevant property or equipment information is disclosed

  • Known hazardous conditions are communicated to us

  • Appropriate authorization has been obtained from the property owner when applicable

Customers are responsible for obtaining landlord, property owner, association, or other third-party approval when such approval is required.

7. Safety and Site Conditions

Cox Climate Control reserves the right to pause, postpone, modify, or decline work if our technicians encounter conditions that may create a safety hazard.

Examples may include:

  • Unsafe electrical conditions

  • Structural instability

  • Hazardous substances

  • Mold or contamination

  • Unsafe attic or crawlspace access

  • Aggressive animals

  • Extreme environmental conditions

  • Unauthorized modifications to equipment

  • Conditions that violate applicable building or safety requirements

Additional work may be required before HVAC or refrigeration work can safely proceed.

8. Parts and Materials

Replacement parts, equipment, and materials may be subject to manufacturer availability.

Where an exact replacement is unavailable, we may recommend a comparable or compatible alternative.

Product specifications, models, availability, and pricing may change without notice.

We are not responsible for manufacturer shortages, supply-chain delays, discontinued products, shipping delays, or circumstances outside our reasonable control.

9. Payment Terms

Payment terms will be provided through the applicable estimate, invoice, proposal, or service agreement.

Unless otherwise agreed in writing, customers are responsible for payment for authorized services, labor, equipment, parts, materials, applicable taxes, and other approved charges.

Failure to make payment when due may result in:

  • Suspension of additional work

  • Cancellation of future appointments

  • Collection activity

  • Other remedies permitted under applicable law

Additional payment terms contained in a written estimate, proposal, invoice, financing agreement, or service contract will also apply.

10. Financing

Cox Climate Control may make third-party financing options available for qualifying customers.

Financing is subject to:

  • Credit approval

  • Eligibility requirements

  • Terms established by the financing provider

  • Applicable interest rates and fees

  • Separate financing agreements

Cox Climate Control does not guarantee approval for financing.

When financing is provided through an independent third party, that provider’s terms, privacy policy, lending requirements, and agreements will govern the financing relationship.

Customers should carefully review all financing terms before accepting an offer.

11. Promotions, Discounts, and Special Offers

From time to time, Cox Climate Control may offer promotions, rebates, discounts, referral incentives, or special offers.

Unless otherwise stated:

  • Offers may be available for a limited time

  • Eligibility requirements may apply

  • Offers may not be combined with other promotions

  • Certain equipment, services, or customers may be excluded

  • Offers may be changed or discontinued as permitted by law

  • Manufacturer or utility rebates may be subject to separate third-party requirements

An advertisement does not guarantee eligibility for a specific discount, rebate, or promotion.

Specific offer terms provided with a promotion will control over this general section.

12. Cancellations and Rescheduling

We understand that plans can change.

Customers should contact us as soon as reasonably possible if an appointment needs to be canceled or rescheduled.

Cox Climate Control may also need to reschedule appointments due to:

  • Emergency service calls

  • Weather conditions

  • Technician availability

  • Equipment or parts delays

  • Safety concerns

  • Circumstances outside our reasonable control

We will make reasonable efforts to communicate scheduling changes promptly.

Any project-specific cancellation, deposit, restocking, or special-order terms included in a written proposal or service agreement will apply to that project.

13. Emergency Services

References to emergency, prompt, fast, same-day, or priority HVAC service do not constitute a guarantee of a specific arrival or completion time unless expressly confirmed in writing.

Response times can be affected by technician availability, call volume, traffic, weather, parts availability, location, and the nature of existing service calls.

If you believe there is an immediate danger involving fire, gas, carbon monoxide, electricity, or another life-threatening emergency, leave the affected area when appropriate and contact the appropriate emergency services or utility provider.

The Website should not be used as a substitute for emergency services.

14. Satisfaction Guarantee

Cox Climate Control is committed to customer satisfaction and aims to provide high-quality HVAC and refrigeration services.

If you believe there is a problem with work performed by Cox Climate Control, please contact us promptly and provide us with a reasonable opportunity to inspect the issue and, where appropriate, correct work covered by our service commitment.

The satisfaction guarantee does not necessarily cover problems caused by circumstances outside the work performed by Cox Climate Control, including:

  • Customer misuse or neglect

  • Work performed or modified by another contractor or third party

  • Pre-existing conditions

  • Failure of unrelated components

  • Manufacturer defects

  • Improper maintenance

  • Power surges or electrical problems

  • Property damage unrelated to our services

  • Events outside our reasonable control

Any specific written warranty or guarantee provided for a particular service or installation will govern that work.

15. Equipment and Manufacturer Warranties

Certain equipment, components, or replacement parts may be covered by warranties provided by their manufacturers.

Manufacturer warranties are separate from any workmanship warranty provided by Cox Climate Control.

Customers may be required to:

  • Register equipment

  • Maintain proof of purchase

  • Follow manufacturer maintenance requirements

  • Meet other warranty conditions

Manufacturer warranty claims remain subject to the manufacturer’s terms, exclusions, and approval.

16. Energy Savings and Performance

Statements regarding energy efficiency, utility savings, equipment performance, estimated operating costs, or potential rebates are estimates unless expressly guaranteed in writing.

Actual results can vary depending on factors such as:

  • Building construction

  • Insulation

  • Weather

  • Thermostat settings

  • Equipment usage

  • Existing ductwork

  • Maintenance practices

  • Utility rates

  • Occupancy patterns

Cox Climate Control does not guarantee a specific amount of energy or utility savings unless expressly stated in a signed written agreement.
